Do you require Notary Services while COVID19 Virus social distancing rules are in place? On March 19, 2020, Governor Andrew Coumo enacted emergency rules allowing remote online notary (RON), until April 18 (pending extension).
“….by virtue of the authority vested in me by Section 29-a of Article 2-B of the Executive Law to issue any directive during a disaster emergency necessary to cope with the disaster, I hereby issue the following directives for the period from the date of Executive Order through April 18, 2020:
Any notarial act that is required under New York State law is authorized to be performed utilizing audio-video technology provided that the following conditions are met:
The person seeking the Notary's services, if not personally known to the Notary, must present valid photo ID to the Notary during the video conference, not merely transmit it prior to or after;
The video conference must allow for direct interaction between the person and the Notary (e.g. no pre-recorded videos of the person signing);
The person must affirmatively represent that he or she is physically situated in the State of New York;
The person must transmit by fax or electronic means a legible copy of the signed document directly to the Notary on the same date it was signed;
The Notary may notarize the transmitted copy of the document and transmit the same back to the person; and
The Notary may repeat the notarization of the original signed document as of the date of execution provided the Notary receives such original signed document together with the electronically notarized copy within thirty days after the date of execution.”
I provide New York State regulatory compliant Notary Services via Skype and online identity location verification. All notary signatures are hand signed/stamped, no digital signatures.
In order to be compliant, you must (1) send me your NYS License front and back, plus entire document you want notarized (unsigned), at least one day prior to video conference. (2) You must have Skype up and running and send me your Skype ID, and (3) you must have audio visual capability either on computer or phone. (4) You must sign the document in front of me on video via Skype, after I verify your identity and location. The call will be recorded and stored as proof of service. (5) You need to be able to scan and send me a clear copy of the executed signature page. (6) You will mail me the original signed document so that I will then hand sign and stamp the original and send it back to you.
This process involves significantly more time and effort than the usual notary process in New York. I charge $35 for each notary signature, bulk notaries will be individually quoted. I accept VENMO for payment, after video call but prior to emailing you the notarized document. Real estate professionals need to know that this fee gives the parties 10 minutes of my time, then it’s $3 a minute for each minute more.
